Legal Counsel

**Description**:
**What you’ll do**:

- Negotiate contract terms and conditions with Gartner clients based on standard Gartner agreement documents and also on Clients’ own paperwork as required, both with private sector and government Clients in LATAM and Portugal, to ensure compliance with Gartner’s policies and applicable laws and regulations.
- Maintain a close working relationship with Sales and Consulting associates in relation to client negotiations.
- Advise on legal issues and risks, approval processes, company policies and procedures.
- Advise on data privacy/LGPD, maintaining Gartner’s position as a 'Data Controller’ (versus a Data Processor) in commercial contracting.
- Provide counsel and guidance to internal stakeholders addressing compliance objectives in the areas of anti
- corruption, data protection, privacy, employment, litigation, and consumer law.
- Internal training - work closely with internal partners to coach and educate them.
- Support Collections and Sales teams in handling termination letters and settling client disputes.
- Organize and maintain bylaws amendments, board resolutions, powers of attorney and other corporate records for Gartner’s subsidiaries in Brazil, Mexico and Portugal, as appropriate.
- Contribute to the LATAM and Portugal and Global Legal Team on the enhancement of processes in order to expedite legal work.
- Provide support and collaboration to Corporate Services departments, including but not limited to Finance, Tax and Real Estate.
- Draft statements and other documents required by public procurement processes.
- Review and negotiate NDAs and contracts with vendors.
- Monitor changes in applicable laws and regulations in LATAM and Portugal and advise the business team on the impact of such changes on the business.
- Guide the legal intern on several activities, such as: consolidation of litigation report, review of legal aspects of client questionnaires, review of clients’ and suppliers’ codes of conduct and other policies.
- Support and collaborate with Gartner in-house Employment counsels and HR function as requested.
- Provide dedicated legal support for Conferences in the territory.
- Collaborate with outside counsel, as necessary.

**Relationships: Internal/External**
- Internal: Sales, Consulting, Delivery, Deal Hub, Order Management and Booking, Pricing, Collections, HR, Tax, Finance, Digital Markets, and the other members of the Global Legal team.
- External: Gartner clients and Suppliers.

**What you’ll need**:

- University degree in law - LLB\LLM equivalent
- Licensed to practice law in Brazil.
- Approximately 6 plus years of experience in the Legal department or a law firm, with a focus on contract review and negotiation (both with private and public sector clients) in multiple jurisdictions in Latin America.
- Strong understanding and experience with the legal framework and business practices applicable to government contracts and public procurement process in Brazil, Portugal and other LATAM countries.
- Language skills:

- Brazilian Portuguese - Native Speaker
- English - Fluent (mandatory)
- Spanish - Advanced plus
- Excellent oral and written communication skills.
- Knowledge and experience of key areas of the law that impact the business, such as data privacy and intellectual property.
- Thrive in a fast-paced environment, characterized by rapid business growth and a changing technology and business landscape.
- Problem - solving skills with an open mindset to offer innovative solutions to legal and commercial challenges.
- Ability to manage the balance between ensuring legal compliance and meeting the needs of the business.
- Ability to prioritize workload based on value of business to Gartner versus complexity of negotiation whilst working to month-end and quarter-end sales deadlines.
- Requires good interpersonal skills both to manage and build relationships with internal and external clients, and to work collaboratively with the Legal & Compliance teammates.
- Experience of working on information technology (desirable).
- Virtual-first working model, with expected time in Sao Paulo office of approximately 1 day per week.
