LATAM Hub - Brazil Legal Job Description

Job Title:  Associate Director Legal – LATAM Hub – Brazil

Purpose of Job:

Be a part of the team that manages regional legal needs of the Brazilian affiliate ("Brazil" or the "Affiliate") of the Latin American ("LATAM") Hub (the "Hub"), and provides legal counsel to the Hub Leadership team.  The LATAM Hub oversees the marketing and sales, and execution of local development matters, of medicines produced by Eli Lilly and Company in Mexico, Brazil, Colombia; as well as oversees strategic distribution relationships in the Southern Cone of South America, Peru, Ecuador, Venezuela, Central America, and the Caribbean ("SPEC").  This position will specifically support Brazil.

Position Responsibilities:

General Responsibilities:  

Serve as a key resource and provide effective day-to-day legal support resulting in legal solutions which help the Affiliate achieve business objectives, minimize legal risks, and comply with local laws, regulations and company policies (legal counseling in various areas of law including corporate structure and support, commercial, promotion, regulatory, transactions, litigation, competition, anti-bribery, FCPA, sanctions, advertising, tax, IP, labor issues). Proactively support the Affiliate in preventing, detecting and responding to legal risks in business operations.  Drive solutions for products, processes and services in the Affiliate.  Monitor, identify, interpret and timely communicate to the internal clients changes in the law potentially affecting business operations. Assist with internal controls and compliance program enhancements. Develop legal strategy to adopt, develop and implement programs, policies and practices in the Affiliate. Make decisions that impact a range of standard and non-standard operational, processes, project or service activities.

Engage cross-functional/ cross-geographical collaboration to replicate best practices.   Participate in regional and corporate assignments/projects. Communicate with lawyers in the International Business Unit and Corporate Center (Indianapolis, Indiana) to ensure one-voice counseling and effective use of legal resources across the geographies.

Defend the company in government investigations/inquiries.  When needed, cooperate with in-house counsel on internal investigations with the assistance of external law firms or in-house HR or Compliance investigation resources.

Develop and conduct training programs for the Affiliate's employees based on identified needs.

Support and lead the implementation of legal strategy, budgeting process, global business solutions, anti-counterfeit activities, AI projects, advocacy activities internally and externally with local associations and legal organizations.

Lead projects with high risk and high complexity, involving management of budget for a broad area of the business.

Actively participate in meetings with local leaders and ensure direct and regular exposure to functional managers.

Foster a culture of Ethics and Compliance, supporting Ethics and Compliance colleagues and maintaining awareness of Company policies and procedures in providing counsel.

Specific Responsibilities:

  • Lead and organize all litigation efforts affecting the Affiliate (labor, product liability, consumer, small claims, government and commercial), by, among other things: developing strategy and coordinating with local leadership, Legal management, and cross functional partners; selecting and managing outside counsel; tracking matters with internal tools; managing budgets; supervising support attorneys and staff who are assisting on litigation projects.
  • Coordinate with other international and Indianapolis-based litigation colleagues across global regions to assess strategies common across geographies, best practices and coordinated use of outside counsel.
  • Partner with peer legal colleagues to provide agile counseling in matters related to pricing negotiations, discount structures, access negotiations, government tenders, customer support programs, marketing practices, supply chain management, B2B activity, Trade Association engagement, training of management or functional employees on legal developments, engagement with ANVISA and other local regulators, corporate affairs advocacy initiatives, medical affairs communications, and clinical trials.

Job Requirements:

Degree in law from atop university

Fluent in Portuguese and English; working proficiency in Spanish.

At least 10 years' experience in an international law firm or in-house legal department of multi-national pharmaceutical company or a Capability Center service company. Experience with and ability to counsel directly in Brazil and one or more major markets in LATAM.

Optional: international or non-pharmaceutical multinational experience.

Skills:

Experience and fluency in the systems, processes and norms of labor, product liability, consumer, small claims, government and commercial litigation in Brazil.  Comprehensive business and technical knowledge/experience to improve products, processes and services. Ability to work independently, lead large-scale projects and programs with moderate risks and resource/financial requirements, engaging teamwork and collaboration. Risk Management skills. Ability to facilitate cross-functional/cross-geographical work. Self-motivated. Highly organized. Ability to anticipate and resolve complex problems. Able to make difficult decisions and stand behind them. Good communication skills (written and oral). Strong interpersonal skills. Ability to establish key relationships and to partner well with others.  Ability to identify internal/external customer requirements and develop solutions to meet customers' needs.
