Main responsibilities:
Strategic litigation management: the person in this role is expected to have a deep understanding of Kimberly Clark Brazil labor litigation, being accountable for best-in-class defense of company's interests in labor lawsuits, by means of:
- Directly involvement and leadership in every strategic labor lawsuit, making sure each case is properly assessed and aligning strategy with company's leadership in advance.
- Management of non-strategic labor litigation, leveraging in-house and outside counsel resources to promote exceptional defense in labor lawsuits.
- Holistic view of company's labor litigation, identifying risks & opportunities and reporting updates to company's leadership accordingly- Monitoring of labor litigation key performance indicators, such as litigation rate, loss rate, outstanding claims etc., using tools such as Power BI;- Continuous improvement on accrual accuracy connected with labor litigation.
- Leading the agenda for settlement proposals, aiming at reducing legal labor exposure- Revision of company's internal procedures and workflows- Outside counsel / vendor management, regarding budget control, biddings, contract negotiations, SLAs (service level agreement) etc.- Proper reporting of labor litigation exposure and updates in company's systems and leadership meetings
Prevent litigation: the person in this role is expected to proactively identify labor risks and root cause of labor litigation, propose solutions and lead work fronts to address identified risks and root causes.
Responsibilities involve:
- Legal advisory to the business regarding labor and social security risks, including sensitive matters that might involve compliance investigations, terminations with cause, among others.
- Legal trainings to the business on labor best practices- Building a solid relationship with key stakeholders (e.g. Human Resources) to foster a preventive labor litigation agenda- Business partnership with Labor Relations department, supporting negotiations with Unions and making sure labor risks associated with collective bargaining agreements are monitored and addressed.
- Continuous revision of company's labor practices, employee documentation and third-party agreements are properly assessed form a labor risk standpoint.
People management: this is a leadership role reporting to the Sr.
Executive Manager position.
It is imperative that the person in this role supports the development of the team, foster a collaborative environment within the Legal Department and also with other stakeholders in the company.
Experience and requirements:
- Law school degree and licensed to practice law in Brazil (OAB active)
- +7 years of experience with Labor Law
- Advanced English
- Spanish is a plus.
- Specialization in Labor Law, in-house experience
- Experience with leadership
- Must-have skills and behaviors: standalone behavior, collaborative mindset, proactivity, strategic thinking, data driven and analytical mindset, hands on
